PANGUTARAN, Sulu - Election watchers Alfrashier Tarang, Albian Jamjahari and Janib Jamjahari were denied of a police blotter on election related incident after they were harassed by armed group led by Nasser Tandih, an alleged kidnap for ransom group member and expert in making bombs in Barangay Tonggasang last May 13, 2019 in a recently conducted Midterm elections, here.

In a media interview the complainants, said they took refuge to the Municipal Police Station of Pangutaran particularly to chief of Police Captain Christopher Dela Vega Jr.

They said his group being the watcher of Pangutaran mayoralty candidate Salam Asta went to the area to prepare for the conduct of elections but instead before reaching the polling precinct they were asked by the armed group to discuss some matters and later to go back and not to proceed and do their task but instead offer some amount of money.

“Nasser told us to go back or accept the money for them to pity their family if they insist in doing their task”. Heated arguments then occurred which the group of watchers took videos for documentation but the armed group took the cellphone and break it but other watchers managed to take pictures of the incident.

The group then proceeded to the police station purposely to make a police blotter with regards to the incident.

Later the group went back to the police station to ask for the extract of the police blotter which Dela Vega told them that police investigator Darwin Sarihani won’t sign the police blotter with no apparent reasons and denied them of the police blotter.

The complainants are seeking assistance from concern agencies to help them secure police blotter for them to file action against those armed group which broke his mobile phone and threatened their lives. (By Ric Clet)

Statement on 2019 Election Results

Failing the People
Quezon City (May 21, 2019) -  Social movements against Charter Change are deeply alarmed that winners are declared for senator and partylist despite many irregularities documented in the 2019 midterm elections, including in vote counting and canvassing.

COMELEC has been amiss in explaining these irregularities in full detail and with transparency, and has not directly challenged overt vote-buying nor the President’s public statement that coax the Filipino masses to accept vote-buying as the norm during elections.

As a result, we believe that the way this election was conducted has tarnished the integrity and credibility of this democratic process. The election is a pivotal exercise that determines the direction and mode of political and economic development in our country.  This newly-elected set of national legislators and local officials will be critical in advancing the shift to a federal form of government by the Duterte administration through Charter Change (ChaCha).

Given the pronouncements during the campaign period of the declared winners, the overwhelming majority of them favor the shift to a federal constitution, clearly prioritizing the interests of foreign investors and the elite over the oppressed majority. They sing the same tune as former President Gloria Arroyo, who only yesterday was asking the Senate to fast-track ChaCha.  Given the track record of Hugpong ng Pagbabago senators, including the co-ownership of mining companies by Senator Cynthia Villar’s family, the brokering by Angara family of economic zone accused of land-grabbing by farmers and indigenous peoples, they will not hesitate to remove the 40% limit to foreign ownership of corporations undertaking exploration of our natural resources.

Most likely, this incoming Congress will also support the Duterte administration’s kill policies – the death penalty, lowering of the Minimum Age of Criminal Responsibility, extension and expansion of Martial Law and the continuation of the war on drugs.  KALIPUNAN resolves to fight and reject these anti-poor and anti-people policies.

As this electoral process is crucial, and hands the future of the most marginalized among us in the hands of winning politicians leaning towards Charter Change and kill policies, the electoral process must first be beyond reproach.

The COMELEC must investigate and explain the irregularities that happened surrounding the elections, including evidences of pre-shading of ballots, intimidation of local governments, uncounted votes of partylists in numerous precincts, the lack of transparency, the failure of Voting Registration Machines (VRMs), the conking out of Vote Counting Machines (VCMs), the lack of ballot marking pens that are used to blot the ballot, rendering these as spoiled votes. Other issues are still being elevated to the court such as the choice of a Duterte-allied party to be the dominant minority party for monitoring.

We support the call of the Parish Pastoral Council on Responsible Voting (PPCRV) and the Kapisanan ng Brodkaster ng Pilipinas (KBP), for the COMELEC to open all recording devices related to the Transparency Server to all stakeholders.  We also share the belief that involving as many stakeholders as possible to observe the transparency server can only enhance the integrity of this election. COMELEC must act immediately, and must not allow itself to be abused by fascist tendencies of an administration that plans to install a constitutional dictatorship. (By Jean Enrique)

By JONG CADION

PAGADIAN CITY, Zamboanga del Sur (May 26, 2019) – A twenty-one-year-old active member of NPA turned over himself together with his M14 rifle to the 44th Infantry Battalion in Ipil, Zamboanga Sibugay Thursday May 23, 2019, Tabak Division Public Affairs Office (DPAO) Official disclosed.

“Alias Jason (not his true name) revealed that due to hardships and frustrations to their commanders that led him to escape from the communist terrorist group and surrender,” said Lt. Col Don Templonuevo, the 44th Infantry Battalion Commander.

Alias Jason was only 19 when recruited by the NPA in his hometown in Ipil, Zamboanga Sibugay. After two years of hurdling unexplained hardships (tired and hunger) in the mountains of Zamboanga Sibugay and Zamboanga del Sur and the false promises of their communist leaders, he decided to lay down his arms to the government and be with his family.

“Together with the stakeholders, we will assist the former rebels (FRs) avail of the government’s Enhanced Comprehensive Local Integration Program (E-CLIP) for them to become productive citizens of our country,” said Brigadier General Bagnus Gaerlan, Jr., commander of the 102nd Brigade which has operational jurisdiction over Zamboanga Sibugay.

Press Statement on the 2019 Election Results

May 17, 2019

The 2019 midterm election is over. Elections should have been the chance of a people to shape their own destiny. Yet, our experience of elections, regarded as the most massive platform for public participation in governance, has sadly always been missing its point of target.

The just concluded election is no different. The traditional politicians many of whom have graft and corruption cases, those with most money for campaign "tokens" or bribes and those with the most popularity and exposure "won".

Cheating, fraud and vote-buying abound. No less than the President consider vote-buying "normal". The vote-buying and glitches on the vote counting machines (VCM) are substantiated by reports coming from our partners in communities who tried to question the irregularities but were not able pursue it for fear for their life and security and distrust from the system.

Three reports have it that they voted for their chosen candidates but receipts included the name of Bong Go which was not part of their choice. Another voted 10 candidates however, the receipt yielded only eight names while the 9th and 10th are just dots. Another received a shaded ballot already. These are just few of the reports which manifest irregularities.

We, from the Philippine Misereor Partnership, Inc. (PMPI), a network of civil society organizations, rights groups, peace and faith-based institutions joins other civil society and church groups to demand accountability and transparency from the Commission on Election (Comelec).

The people have the right to know and be clarified:

Why was there a lull of 7 to 9 hours in the transmission of results to the transparency server, media and watchdog groups?
Why is there a sizable increase in glitches in the VCM and SD cards this year compared to previous elections?
Why is the central server and "meet me room" set-up of Comelec kept secret?

Why were the depository of receipts of the casted ballots unsealed and in carton or plastic boxes only?
Why is there lack of information on the voting process and there was no instruction during precinct voting on the manner of voting which lead to over-voting and inability of many to vote party list groups?
Weeks before the election we are mulling over these questions:
Why did the Comelec refuse to allow NAMFREL to have an open access to the data and information in real time of the transmission of results?
Why did the Comelec declared Nacionalista Party (NP), a known ally of the majority party as the dominant minority opposition?
In the spirit of transparency and accountability, these questions need be answered by the Comelec as these paint seeming conspiracy by the Comelec to rig the election.

The inability of the Comelec to explain what cause the sudden stoppage of transmission during the actual lull is unacceptable. There was no clear and thorough explanation on the so called "java error" provided during the lull. And when it finally resumed 90% of votes have been counted! Likewise keeping secret the central server and "meet me room" is a violation of the Omnibus Election Code.

The 1,699 voting counting machines (VCM) challenged by technical glitches, out of 85,000 VCMs, and almost a thousand SD cards malfunctioned compared to 188 only in the 2016 election reek of inefficiency and unpreparedness. Even a newbie technical person would know that a huge data flooding the transmission and server needs a backup system.

Furthermore, the ruling of Comelec declaring the Nacionalista Party (NP), four days before the Election Day, as the dominant minority party is puzzling. This is crucial because under the Omnibus Election Code, the dominant minority party, which was previously the Liberal Party, are guaranteed to receive copies of the election returns and certificates of canvass to ensure fairness and transparency. Is this a move to prevent the opposition from counter checking the result of the election?

PMPI demands an explanation from Comelec. We push for the creation of an independent body to investigate the accountability of Comelec in this seeming conspiracy and fraud and its sheer inefficiency and irresponsibility.

We will not rest until a proper investigation of these allegations of a fraudulent election and conspiracy is initiated. We will help document cases of election related fraud and irregularities. We will remain vigilant. We will continue to be watchdogs and hold accountable the culprits. We call on the people to come forward and report cases and experiences of election related anomalies.
